ACCOMAC COUNTY COURT.
Proceedings, September Term, 1894.
Estate of Sallie H. Dix, widow of John S. Dix, deceased, was committed to John H. Wise, sheriff, for administration.
Charles T. Evans was appointed and qualified as guardian of Carson Egbert Kilmon, orphan of Henry L. Kilmon, deceased.
D. F. White qualified as administrator of Betsy Gray, deceased, and Thos. W. Russell as administrator of Susan T. Fitchett, deceased.
Joseph E. Brodwater tendered his resignation as guardian of Willie Pettit, and same was accepted by the court.
W. A. P. Strang, J.P., paid into court $2.50 fined imposed on Al Drummond for breach of peace, and Levi R. Boggs, J.P., paid into court $5 fine imposed on Isaac and Lee Walker for petit larceny.
Ex parte: Petition of John Rew's executor. Order authorizing check on Marine Bank for sum to pay costs and for payment of share of Mrs. Emma F. Taylor, wife of Ezekiel Taylor.
Christian Hanson and Wm. J. Burton returned their respective qualifications as commissioners to designate natural oyster rocks, beds and shoals.
The following fiduciary accounts were confirmed and ordered to be recorded: Orphan accounts of John W., Amanda W. and Thomas H. Window, Susan and Marion Hall; trust accounts of John M. West and wife, &c, and audit of estate of Benjamin F. Custis.
Ex parte: Petition of John Daisey &c's guardian. Order authorizing check by county treasurer on Marine Bank for payment of taxes for years 1892, 1893 and 1894.
Wm. Walsh qualified as notary public for county of Accomack.
Inquest held over dead bodies of A. Thomas Bowden and John H. Fisher by justices of peace, acting coroners, were returned to court and filed.
John E. Wise was appointed and qualified as assessor of lands for year 1895 in upper parish of Accomack, district No. 1, and John J. Blackstone was appointed and qualified as assessor of lands in lower parish, district No. 2.
Accounts against Commonwealth in criminal and lunacy cases were allowed as follows: Joseph C. Wescott, constable, $5.96; Wm. L. Hutchinson, guard of schooners William E. Price and C. W. Stevenson, $212.60, and Peter H. Dies, guard for same, $76.00; R. P. Reynolds, J.P., (3 accounts) $1 each; Emory Phipps, constable, (2 accounts) $51.05 and $25.70: James H. Fletcher, Jr., attorney for Commonwealth, $105.00; M. Oldham, Jr., clerk, $13.30; John H. Wise, sheriff, $53.25, fees as sheriff and jailer, $153.55 for board of prisoners in jail, and $28.57 for board of lunatic in jail; Rebecca Jones, nurse and guard of lunatic in jail, $28.50; J. W. Edmonds, editor, $5.00.
Order entered directing commissioner of accounts to examine official bond of county treasurer and report whether said bond is sufficient in all respects.
Ex parte: Petition of John Barnes of James, and 26 other residents of Accomack. Petition filed, alleging that twenty five acres or more of oyster beds, rocks or shoals, lying in Hunting Creek adjacent to Pocomoke Sound, are omitted from Lieut. Baylor's survey. Order entered appointing Charles P. Finney, John Colonna and Wm. Henry Harrison Lewis commissioners to examine and report whether or not the facts contained in petition are true.
James H. Tindle, late surveyor of road precinct No. 7, Atlantic district, filed the annual report due from him at the March term last, and order was entered on county treasurer in his favor for $5 for services, &c., as surveyor of roads.
Ex parte: Petition of John A. Bundick, late guardian of Charles A. Gibbons et als. Petition filed by Stanley J. Lewis & Co., setting forth the indebtedness of the infants to them, and order entered for payment of same and cost.
Proceedings to condemn the bateau of Burwell B. Gladding for being employed in taking oysters unlawfully, was dismissed on motion of attorney for Commonwealth.
Commonwealth vs. Floyd Trader (on indictment for dredging oysters feloniously). Defendant was tried, convicted and sentenced to thirty days in county jail and to pay fine of $15 and costs of prosecution, which cost and fine amount to $59, and he has also to pay board in jail.
Upon application of Raymond Hall and Edward R. Thomas for a ditch. Notice to proprietors of land through which said ditch would pass, except Wm. H. Miles and Thos. A. Northam, and case continued on motion of petitioners until first day of next term.
