ACCOMAC COUNTY COURT.
Proceedings, May Term, 1891.
An inquest held by S. R. Nelson, J.P., on 30th day of April 1891, over body of an unknown child lying dead near Keller, was returned to court and filed.
Emory Maffitt, J. P., paid into court $2.00 fine received of Cora Barrett, and a like fine received of Ezra Barrett, for working (other than as matter of necessity or charity) on Sabbath day; Robert T. Harmon, J.P., paid into court $2.50, fine received of Jos. H. Hargis, convicted of assault and battery on Levin L. Hopkins; S. R. Nelson, J.P., paid into court $2.50, received of Tully J. Scott, convicted of assault and battery on Spencer Wise, and a like fine of $2.50, received of Arthur Wise, convicted before him of contempt.
The following fiduciary accounts were confirmed: Audits of estates of John H. Ross, Edward T. Wise and George W. Powell, deceased; Orphan accounts of Leila M. and Oscar J. Powell, Henry O. Rew, Virginia S. Powell nee Mears, Charles Thomas Scott, Charles Robert and John Thomas Allen; Trust accounts of Caleb L. Taylor, Upshur K. Broughton and wife, &c, and Benjamin C. Bloodgood and wife.
William B. Mapp qualified as administrator of George Ashby, deceased, and Melvin E. Witham of Florence D. Witham, deceased.
John W. Kellam qualified as guardian of Tankard G., Richardson D. and Carroll C. Kellam, orphans of John R. Kellam, deceased, and Michael Glennan qualified as guardian of Elizabeth G., Anne Belle and Marietta G. Scarburgh, infant children of George T. Scarburgh.
David Evans was exempted from capitation tax because physically too infirm to perform manual labor.
Accounts against Commonwealth in lunacy and criminal matters were allowed as follows: Tankard Kellam, $46.66 (lunacy account). John H. Wise, sheriff and jailer, $64.20 (board of prisoners in jail).
Orders on county treasurer were entered for Levin J. Gunter, captain of chain gang for $13.50 and Levin Thomas Lewis, assistant, $87.50
Certificate to obtain law license was entered in favor of Benj. T. Gunter, Jr.
Benj. T. Gunter, Jr., was appointed county Surveyor for term of four years from first day of July, next.
Archibald Annis was appointed superintendent of poor for term of four years from first day of July next, and qualified.
Inspectors of oysters reported as follows: Solomon Warner, of 2nd district, for quarter ending May 31st, 1891, collections $28.05, due State $25.25; Walter F. Brodwater's administrator, for quarter ending February 28th, 1891, collections $292.72, due State $268.45; Charles P. Finney, of 8th district, for quarter ending May 31st, 1891, collections $19.10, due State $17.19; same for 9th district, collections $30.75, due State $27.69.
The judge made out a list of 268 persons who are to serve as jurors during the ensuing year for trial of misdemeanor and civil causes.
Venire facias was awarded for a special grand jury to be empannelled on first day of next term.
Wm. J. Barnes, inspector of 5th district, made report in pursuance of the order of the court in the matter of assignment of oyster planting grounds to Frederick Gunby and Edward J. Corbin, which was entered of record and case removed from docket.
In matter of information filed by attorney for Commonwealth against bateau of Joseph H. and Albert L. Taylor, a continuance was granted on Commonwealth's motion because of the absence of a material witness.
Ex parte: the petition of John K. Rogers' administrator. Order confirming report of receiver for checking out the annual interest upon the fund in Marine bank, payment of costs, receiver's commission, costs of proceedings and the balance to Susan E. Taylor, the life tenant of the fund.
Orders in favor of Wm. T. Dix, surveyor, to repair public bridge, and John F. Dies, surveyor, to repair foot bridge, and appointing James T. Hurst, commissioner, to receive proposals for building a public bridge over branch at head of Back creek, near Justiceville postoffice.
Bar-room and retail liquor license were granted to Wm. H. Parker, Tasley station, and bar-room license to Wm. T. Winder, Onancock.
Bar-room license was refused to George A. Jackson, at Onancock, who entered an appeal from the decision of the court to the circuit court.
Samuel Martin was appointed surveyor of roads in place of Augustus T. Doughty, resigned.
Orders on county treasurer in road and bridge matters were entered as follows: Joseph C. Boggs, $27; Henry T. Mason, $3.96; John W. Turlington, 20 cents; Thomas W. Taylor, $40; Wm. F. Rogers, $12; John W. Mears, $1.20; N. W. Nock, $4; Joseph R. Riggs, $2; Frank Fletcher, $1; Wm. L. Long, $2; Wm. T. Parks, $1.
Fred Runge, a native of Germany, declared on oath that it is his bonafide intention to become a citizen of United States.
Upon application of Noah E. Miles, surveyor, for means to repair his road, (known as Sykes Island road). Viewers filed their report and court approved it as to an expenditure for said road of $725, and certified the same to Board of Supervisors for its action as the law requires.
Wm. E. Northam, surveyor, filed his application for means to repair his road near the residence of Wm. H. Marshall, and the court appointed Albert Gillespie, viewer to examine and report as to necessity of it, &c.
Ex parte: the petition of N. Judson Kellam's admr. Order entered confirming the report of S. T. Ross, commissioner, showing the respective interests of the infants on the money withdrawn from bank by the guardian, Jno. E. Mapp, and removing the cause from the docket.
Frank DeKay, appellant, vs. Zadoc Mears, appellee, (appeal from judgment of J.P., recovered by Mears against DeKay). Witnesses heard and case submitted without argument, and judgment of Justice reversed, appellees warrant dismissed and judgments for appellant's cost incurred about his appeal and also before the J.P., in defence of the warrant.
Petition of Jas. G. Fox and others for public road from Gargatha to Leemont. Report of viewers returned and filed, order entered approving the building of the road and directing the proprietors and tenants of the lands proposed to be taken for the same to be summoned to show cause against it.
