ACCOMAC COUNTY COURT.

Proceedings, February Term, 1896.

Accounts against Commonwealth, payable out of State treasury in criminal and lunacy cases and other matters, were allowed as follows: Emory Maffitt, J.P., $5.50; Thos M. Truitt, constable, $9.95 and $4.10; C. B. Finney, witness, 50 cents; Wm. J. Barnes, guard, $42.80; M. Oldham, Jr., clerk, $6.79 and $3.55; J. W. Edmonds, $2.50; B. T. Gunter Jr., attorney for Commonwealth, $90; jailer, $66.96.

Following fiduciary accounts confirmed and ordered to be recorded: Audits of estates of Annie M. Smith, Geo. T. James, Mary A. E. Johnson, James Martin, colored, and John Hart; orphan accounts of William Bagwell, Harry Thompson and Mary Eliza Mears, Henry Olive Rue and Lena Brittingham.

Thos. W. Russell qualified as administrator of Elizabeth A. Thornton, and James E. Grinnalds as administrator of James H. Grinnalds.

A special grand jury was empanelled and returned as true bills: one indictment for murder, one for malfeasance in office, one for forgery, one for housebreaking with intent to commit larceny, one for felonious seduction of a female of previous chaste character under promise of marriage, four for taking oysters feloniously; and not true bills: one for selling liquor unlawfully, and one for failing to make return of sales to inspector of oysters.

Qualification of William J. Rue as mayor of the town of Belle Haven was returned to the court and recorded.

Joshua T. Sharpley qualified as notary public for the county of Accomac.

E. T. Powell, county treasurer, made report of sales of delinquent lands for year 1893, and delinquent lands for said year redeemed before sale.

Upon petition of Tully J. Matthews for a public road. Summons was awarded against Thorogood Mason of Wm. to show cause if any against the road.

Ex parte: Petition of administrator of Jas. Mers, colored, (John E. Mapp). Petition filed, order for payment of costs and for deposit by administrator in Marine Bank.

Commonwealth vs. William Redman and Major L. Holden on a notice of scire facias. Cause continued.

John T. Powell's administrator vs. Solomon Bayly and E. T. Powell, surviving partner of Powell & Garrison vs. same. Cause returned to court and put on docket.

Ex parte: Petition of Wm. James Mapp's late guardian. Report of late guardian filed and confirmed.

Benjamin Jester, prisoner in jail, committed by Emory Maffit, J.P., paid the costs of his prosecution and gave bond to keep the peace twelve months as required by the Justice and was released from jail.

Ex parte: Petition of Annie R. Lewis, &c's, late guardian. Death of Elsie M. Lewis suggested on the record and report of late guardian filed, order confirming report and directing said Lewis' administrator to withdraw from fund his share thereof.

Ex parte: Petition of Lloyd T. Bowden, &c's, late guardian. Report of L. Floyd Nock, late guardian, filed and confirmed.

Ex parte: Petition of Judson R. Collins' late guardian. Report of late guardian filed and confirmed and petition of Lavinia W. Collins filed and cause referred to commissioner.

Commonwealth vs. Jesse W. Crockett Jr., (on indictment for felony). Default of the defendant entered and scire facias awarded against him and his sureties to first day of next term and venire facias awarded for trial of said defendant to first day of next term.

Ex parte: Petition of Annie Kelly's administrator, (J. H. Fletcher, Jr.) Report of administrator filed and confirmed.

Order entered directing distribution to legatees of Annie M. Smith's estate without refunding bond.

Ex parte: George S. Hoffman's late guardian. Report of J. W. G. Blackstone filed and confirmed.

Henry Smith, convicted of perjury, for falsely obtaining a marriage license, was released from jail, being unable to pay fine and costs.

Commonwealth vs. Sydney Mason (on indictment for housebreaking with intent to commit larceny). Cause continued on defendant's motion to fourth day of next term.

On application of Mary E. Tyler, Henry L. Crockett was appointed trustee in deed from John D. Tyler and wife in place of Geo. T. Tyler, trustee.

Commonwealth vs. Solomon W. Tyler (on indictment for taking oysters feloniously). Default of defendant entered and John Somers, his security, paid the amount for which he was bound as such into court.

Commonwealth vs. Wm. T. Lewis (on three indictments for taking oysters feloniously). Venire facias were awarded for trial of said defendant on 2d day of next term.

William T. Lewis, who was recognized to appear and answer indictments made default, and scire facias were awarded against him and his sureties.

Orders were entered directing local option elections to be held in the magisterial districts of Lee, Pungoteague and Metompkin on Saturday April 18th, 1896.
