ACCOMAC COUNTY COURT.
Proceedings, March Term, 1898.
Resolutions of respect to the late Hon. Benjamin T. Gunter by the Bar and officers of the court were produced into the court and spread upon the records.
John S. Parsons was appointed and qualified as commissioner of accounts.
J. Columbus Justis qualified as administrator of Samuel Justis of I.
Accounts against Commonwealth in criminal and lunacy cases were allowed as follows: For S. R. Nelson, J.P., $1.50 and $1; Jos. Wescott, constable, $12.94.
The will of Thomas H. Selby was proved and L. Floyd Nock qualified as administrator with will annexed.
The will of Mary S. Wright was proved and William T. Wright qualified as executor.
James T. Lunn was appointed and qualified as a committee of the person and estate of Thomas Watson, of Chincoteague, a person of unsound mind.
Order entered, by consent, removing James C. Doughty from office as guardian of John W. Bailey et als., orphans of William Bailey, deceased.
Augustus S. West was appointed and qualified as guardian of John W., Virginia G. and Annie E. Bailey, orphans of William Bailey, deceased.
Order entered directing commissioner of accounts to examine the official bond of the county treasurer and report whether the same is sufficient in all respects.
S. R. Nelson resigned the office of Justice of Peace.
John H. Wise, sheriff, returned to the Judge a list of prisoners in jail.
Mac Selby was discharged from jail, having served out the time for which he was committed and being unable to pay costs for which he was imprisoned.
John W. Stiles vs. Commonwealth (on appeal from judgment of Justice of Peace for shooting wild water fowl, to wit, brandt in night time). The appeal was dismissed having been awarded by mistake.
On petition of Oaknal J. Humphreys &c's late guardian. Petition filed and money brought into court by L. Floyd Nock, late guardian, who was ordered to pay costs and to deposit balance of money in Marine Bank of Norfolk, on interest account.
On petition of William H. Matthews and others for a public road. Report of William W. Lang, commissioner, filed and confirmed and order for payment of damages for land taken for road, commissioner for services and costs incurred by petitioners.
On application of road surveyor to repair public bridge at Masonville. Report of executrix of road surveyor filed and confirmed and order for payment of expenses incurred to the persons entitled thereto.
On petition of Emory J. Chase administrator. Report of administrator filed and confirmed.
On petition of Geo. S. Nock and others for a public road from S. R. Nelson's Bagwell farm to Onley. Petition filed and order appointing viewers.
On petition of Alexander W. Lilliston and others for public road from Tasley Station to road from Court House to Onley. Petition filed and viewers appointed.
William Walsh vs. Walter E. Morris and wife (on attachment). Agreed dismissed.
On petition of Florence M. Lewis' late guardian. Report of L. Floyd Nock, late guardian, filed and confirmed.
On petition of Fletcher Drummond and others to change voting place from Masonville to Parksley. Petition filed, evidence of notice heard, order for publication of proceedings in PENINSULA ENTERPRISE and cause continued until first day of next term.
On petition of James Alfred Mapp's guardian. Report of L. Floyd Nock, guardian, filed and confirmed.
On petition of William J. Matthews and others for extending public road on Chincoteague to Chincoteague and Assateague inlets. Petition filed and order appointing viewers.
On petition of Joseph L. Cooper and others for a public road on Tangier Island. Order to summon proprietors and tenants of the land to show cause, if any they can, why said road should not be opened.
Jacob Rogers vs. Jay Parks (on a warrant in detinue for one dark bay mare). Motion entered by defendant to dismiss warrant overruled, plea of non detinet and issue, jury empanelled and plaintiff non-suited, and judgment for defendant for $5 and costs of defense.
Trifany Only vs. John W. Holland (on attachment). Petition filed by Dorsey W. Lewis, claiming a part of the proceeds of sale, by virtue of a bill of sale of the property levied on and sold by the sheriff. Evidence and argument heard by the court, petition dismissed and judgment for plaintiff's costs.
Annie Kelly's administrator, Geo. W. Hinman's administrator, Chas. A. Gibbons &c's late guardian, Edward H. Conquest Sr.'s administrator, vs. Mary E. Taylor and others (on petition) and John E. T. Window's executor vs. Wilbur T. Window (on petition). In each of the foregoing cases an order was entered directing the county treasurer to check on the funds to their credit in Marine bank for taxes 1896 and 1897 on said funds.
