ACCOMAC COUNTY COURT.

Proceedings, January Term, 1888.

The following fiduciary accounts were confirmed: Audits of estate of James N. Ward, Elizabeth C. Young, Thomas T. Gray, Hannibal Fletcher and Robert H. Miles; Trust accounts of William T. Dryden; Orphan accounts of George A. and Bessie Fentress, Alfred M., Ida A., Clara S. and Wm. W. Mason.

Last will of Thomas L. Trower probated, and John E. Mapp qualified as executor.

Last will of John Rew probated and Frank Fletcher qualified as executor.

Last will of Robert Andrews probated, and James A. Hall qualified as executor.

Last will of Mary E. Johnson probated.

A writing purporting to be the last will of John R. Fletcher, deceased, was offered for probate, which was refused by the court after mature inspection of the writing and due consideration of the arguments of counsel and the evidence adduced. An appeal was allowed to Elizabeth R. Fletcher, legatee to the circuit court, commencing 1st Tuesday in April next.

William T. Mason qualified as administrator of James Kilmon of James.

John R. Sturgis resigned as guardian of Elijah W. Sturgis.

John L. Trower and Douglas A. Trower were appointed and qualified as guardian of their sisters, Anna D. and Lena E. Trower.

George M. Parks, qualified as guardian of his infant child, Herbert H.

James W. Broughton, registrar of Temperanceville precinct was ordered to copy the registration books of said precinct.

William F. Nock and Capt. Kendall Thornton were exempted from the payment of capitation tax because of physical incapacity to perform manual labor.

Walter J. Hall qualified as Notary Public for the county of Accomac.

Bar room license of George W. Trower at Dunkirk was transferred to David F. Ward, assignee.

Bar room license of John B. Downing at "Mill Ridge" was transferred to Charles K. Taylor, assignee.

Orders on County Treasurer in road and bridge matters were entered as follows -- William A. Burton, $9; John R. Coard, $6.25; A. J. McMath and Levin R. Lewis, $5 each; Samuel Baker, $4; Andrew J. Kellam, $10.82; John W. Kellam and James E. Harrison, $8 each; Ira Payne, $30; George W. Hinman, John T. Fletcher, Charles W. Fedderman, David D. Abbott, William L. Lang and William H. Green, $1 each; Albert Gillespie, J. G. Matthews and David D. Abbott, $2 each.

William J. Eichelberger was appointed surveyor of the road in place of Alfred McMath, John J. Gunter in place of Andrew J. Kellam, William H. Coxton in place of Oswald J. Adams and John J. Tunnell in place of William W. Ling.

Henry Beasley, surveyor, petitioned for an appropriation of $94.74 to repair his road precinct. The expenditure was approved by the court and certified to the Board of Supervisors.

An appropriation of $90 to shell the road from corporation limits of Onancock to Point of Fork was approved by the court and certified to the Board of Supervisors.

Viewers reported in the following cases -- petition of Louis F. Marshall and others for a public road (and proprietors were directed to be summoned.) John M. Bloxom and others for a public road, and Albert F. Mears and others for same.

A. J. Morse, surveyor and others petitioned the court for an appropriation to improve the public road leading to Hoffman's wharf from the Hack's Neck road and viewers were appointed to examine and report the necessity, &c.

Leroy C. Bulman, inspector of oysters for 4th district, made report for the quarter ending November 30th, 1887, amount collected, $9.62. due the State $8.63.

The local option cases against James S. Nock and George T. Clayton were continued because of the absence of material witnesses for the defense.

Neal U. Taylor, constable paid into court $2.50, fine collected of Ellen Cropper, convicted before a Justice of the Peace of assault and battery.

Motion entered to distribute estates of Wm. E. Jacob and Benjamin T. W. Byrd, without refunding bond being given and creditors directed to show cause against same on the 3d day of next March term.

Ex parte; Petition of N. Judson Kellam's administrator. Petition filed by Cordelia S. Kellam widow for allowance for the support of infant children and cause referred to master commissioner for inquiry and report.

Ex parte; Petition of Benjamin T. W. Byrd's administrator c.t.a. Order construing the will of said testator in favor of Tabitha Ann Byrd, widow and directing payment of costs.

George W. Barnes, administrator, c.t.a. vs. Frank Barnes &c, and ex parte petition of John A. Bundick's administrator c.t.a. Orders entered authorizing county treasurer to check on funds in Marine Bank for 1887 taxes.

Ex parte; petition of Edward Melson's administrator. Order authorizing Gunter & Blackstone to check on funds in Marine Bank for unpaid costs of cause, 1887 taxes and allowance to widow for the support of her infant children.

Report filed by Wm. H. Rew, surveyor of expense incurred in building footway over Poor House Branch, which was approved by the court and certified to the Board of Supervisors.

Petition of D. F. White and others for a public road at Leemont. Order entered establishing the road as a public road, it being already opened and adding the same to road precinct No. 11 of Metompkin district, of which Emory W. Williams is a surveyor.

Neal U. Taylor, constable of Atlantic district tendered his resignation which was accepted by the court and Geo. T. Gladding was appointed to fill the vacancy.

Accounts vs. Commonwealth for criminal charges were allowed as follows: E. W. Hutchinson, J.P. $3; M. H. Higgins, J.P., $3; Ernest Koenig and John Darby, guards, 75 cents each; and George T. Scarburgh, physician to jail, $17.
