CHAP. 44.--An ACT to authorize the town of Chincoteague, in the county of Accomac, to cross and maintain across certain lowlands, marshes, meadows, and waters in Accomac county, Virginia, certain pipe lines and electric lines.

Whereas, the town of Chincoteague, in Accomac county, has spent large sums in and about the construction of a water supply system for furnishing of fresh and wholesome water to the inhabitants of said town; and

Whereas, in order to do this it is necessary to bring to said town, water from the mainland through pipes and mains across lowlands, marshes, meadows, creeks and other waters; and

Whereas, in the operation of said water plant, the construction of a power line is necessary; and

Whereas, the title of such lowlands, marshes, and meadows is in the Commonwealth, the same being ungranted and unpatented waste lands.

1. Be it enacted by the General Assembly of Virginia, That the town of Chincoteague, in Accomac county, be, and the same is hereby authorized and empowered to build, erect, construct, preserve, and maintain all necessary pipe lines, water mains and instrumentalities of every kind whatsoever necessary, needful, or useful, in the operation of its said water plant; and also, to build, or cause to be built, erected, constructed, preserved and maintained all power lines necessary, needful, or useful, either in the operation of its water plant or for the furnishing of light and power to persons on the mainland, across Chincoteague marsh, Cockle Creek, Queen Sound and any or all other lowlands, marshes, and meadows and the creeks, streams, or streamlets intersecting said lowlands, by whatever name or names said lowlands, marshes and meadow or said creeks, streams, or streamlets are known, lying between Chincoteague Island, in Accomac county, and W. H. Hickman's farm, in Atlantic magisterial district on the mainland in said county. And the said town of Chincoteague is hereby given and granted any and all rights necessary and needful for the building, erection and construction of said pipe lines, water mains, or power lines, including everything incident thereto, or necessary, or needful for the construction and operation of the same, and further, for the maintenance, operation/preservation and repair thereof.

2. The said town of Chincoteague is hereby authorized to permit the Chincoteague Light Company, Incorporated
, to construct, operate and maintain the power line authorized by this act under the right of way or easement herein granted to said town, and after the expiration of the present franchise of said Chincoteague Light and Power Company, Incorporated, to grant such right to any other corporation, or person, acquiring said franchise.

3. All acts and parts of acts in conflict with this act are hereby repealed.

4. An emergency existing, this act shall be in force from its passage.
